Board of Supervisors Meeting

Attendance:  Chairman Kenneth Miller, Jr., Vice Chairperson Zoë Perkins, Member Barry DiLibero, Township Manager James Wendelgass, Stephen Siana of Siana, Bellwoar & McAndrew, LLP, Township Solicitor, Zoning Officer Sandra Cantrell-Edwards and Township Secretary Tammy Swavely.

 

Chairman Miller called the meeting to order at 9:07 AM.

 

Reports: 

 

Township Building:  The Township is in need of a vehicle to access the Weatherstone Open Space and the Waste Water Treatment Plants.  The Chief of Police and Emergency Management Officer informed the Township Manager that during the last storm they could have used a vehicle to access places that a car or truck could not get around on the streets because of downed trees and power lines.  To address these needs, the departments proposed the purchase of a John Deere Gator XUV 850D.  This is on the state contract.  DiLibero stated that he feels a 4-wheeler would do the same job and be less expensive.  This will be tabled until the Police Chief can come to a meeting to discuss it.

 

Township Manager Report:  The Township Manager Report for the week ending 8/16/08 was acknowledged as submitted.  Wendelgass informed the Board that the Township was contacted by Dominion Gas Company and that they are in the preliminary stages of mapping out a new pipeline easement to carry natural gas through West Vincent Township.  Miller stated that someone from this company has approached him to inform him that they want a 150’ right-of-way through his property and another five (5) acres for a monitoring station.  French and Pickering Creeks Conservation Trust is concerned with this since Dominion seems to be targeting their eased properties.  This is federally regulated by the Federal Energy Regulatory Commission (FERC).  Wendelgass stated that he does not know if the Pennsylvania Utility Commission will have any say in this matter. 

 

Police Report:  The Police Report for the month of July 2008 was acknowledged as received.  

 

Active Subdivision List:  There are currently no pending deadlines.

 

Bills List:  The Bills List was reviewed.  Perkins made the motion to approve the Bills List dated 8/15/08 in the total amount $70,691.86.  DiLibero seconded the motion which carried unanimously.

 

Subdivision/Land Development:

 

Weatherstone:  An Escrow Request has been made from The Hankin Group.  This has been reviewed by Carroll Engineering and they have made recommendations for release.  Perkins made the motion to approve the release of Certificate of Completion No. 3 for improvements to Westover and Fellowship Roads in the total amount of $92,332.68.  DiLibero seconded the motion and it carried unanimously. 

 

Oxford Rise:  An Escrow Release Request was received from Oxford for release #11 on the Waste Water Treatment Plant.  Perkins made the motion to forward this to the Township Engineer for review.  DiLibero seconded the motion which carried unanimously. 

 

Old Business:

 

Michelle Thomas came before the Board of Supervisors to discuss her property on Weidner Way, Tax Parcels 25-7-46 and 25-7-47.  This was the subject of a Lot Line Change, a Conditional Use, and Conditional Final Approval on 5/21/07.  Thomas claims that this was a subject of a previous subdivision called Glad Acres in 1958 which at that time divided the property into six (6) lots.  The Township has no record of this being an approved subdivision and informed the Chester County Recorder of Deeds of such.  Thomas claims that this has hindered the sale of one of these lots and Thomas would like to know if the plan would be recognized by the Board.  This would entail changing at least two (2) of the other residents deeds on Weidner Way.  The Board will discuss the issue and get back to her.  

 

Environmental Advisory Committee:  Vicki Laubach, Chairperson of the EAC, informed the Board that the Township Engineer has produced a list of native plants that should be added to the Zoning Ordinance.  They are in the Natural Lands Trust Stewardship Guide and a notation could be added to the Zoning Ordinance and SALDO refer to that if that list would be preferred by the Board.  Laubach also informed the Board of a new project proposed by Chester County.  Heritage Preservation Coordinator, Karen Marshall is working with Townships in preparation of a Historic Atlas.  This is free to all Townships and included is a 11 x 17 booklet with all the properties in the Township over 50 years old.  They will also be added to be a GIS layer.  The first survey of the historic properties was done many years ago by Estelle Cremers and French and Pickering Conservation Trust.  This will compliment that document but will update it by adding parcel numbers.  The Atlas will be color coded by age.  This is something that should be revisited every ten (10) years for an update. 

 

New Business:

 

Steve Meyer, representing Glenmoore Eagle Youth Association, came before the Board with questions on the field use and the proposed reseeding of the fields this fall.  The fields need to be closed this fall for an overhaul which will include aeration, reseeding, fertilizing and weed control.  Meyer stated that the GEYA Little League in District 28 is in need of this field and would like the Township to put off closing the field until November 2008.  Wendelgass informed him that the problem is the growing season.  If this is done in September, the grass will have more opportunity to grow before the spring season.  If the closing is delayed, it might happen that the fields would have to be closed during the spring season if they are not fully grown back.  Meyer agreed that the spring season would be more important to use the fields then the fall.  The new elementary school is planning to have a field.  He will contact them to see when it will be ready.  He will report back to the Board to let them know the outcome. 

 

The West Vincent Police Department is in need of a new part-time officer.  Police Chief Swininger informed the Board that Eric Sauermelch has successfully completed his psychological and physical exam and his pre-employment background check and is respectfully recommending the Board of Supervisors hire Mr. Sauermelch.  Perkins made the motion that West Vincent Township hire Eric Sauermelch as a part-time police officer.  DiLibero seconded the motion which carried unanimously. 

 

Robert Hall, Francis A. Hall Insurance Company presented a power point presentation of the proposed insurance coverage on Township property.  Miller asked if this insurance carrier provides safety training.  Mr. Hall stated that Selective Insurance does provide that at no cost and will be in contact with the Township to set up a date. 

 

Business from the floor:

 

DiLibero informed the other members of the Board that he is still having a problem with the requirement of a performance bond on the road repairs.  He feels that the Second Class Township Code Section 3102 requires one, regardless of the legal advice given to the Board by its Solicitor.  He stated that he feels that any road maintenance that was included in the previously approved bid should have been bonded.  The Township Solicitor gave the Board a memo outlining its position after checking with PSATS stating that a bond is not required on projects that are less than $10,000.00.  DiLibero disagrees with this memo at this time and he would like to rescind his vote in favor of awarding the 2008 Road Repair and Maintenance Bid.  Siana stated that he cannot rescind his vote.   Also the Township does not have the ability to now require the low bidder to supply a bond since it was not a requirement of the original bid.   Siana also noted that the bid had already been awarded.  Also, it is not possible to establish how much the bond would have to be since there are rules governing how much can be set.  A bond cannot exceed the amount of work that is to be done.  It is difficult to set a bond amount for yet to be identified small repairs to roads.  DiLibero stated that he would like to know what he can do since he would like to change his mind on the bid award.  He still feels a bond is required.  Siana will research this question for him. 

 

A question was asked by a resident on who determines the projects.  Miller responded that the Road Master determines what roads get done and when. On Sheeder Mill Road, the Road Crew did almost all of the work themselves which does not require bidding.  The materials are provided under the State Contract and the actual paving work was less than $10,000.00 so this was done by the low bidder of the 2008 Road Repair and Maintenance Bid, D.L. Fleck. 

 

DiLibero stated that he would like to have the Road Crew vehicles have decals to identify them as being owned by the Township.  The sample was sent to Laurel Printing so as not to have Supervisor DiLibero incur any liability for his generous offer of doing it for them.  

 

Jim Hall, Weatherstone HOA would like to know when the No Parking signs will be installed.  Miller stated that the PA One calls should be going out this week.  The Road Crew is currently looking into paint that does not last as long as the paint that is traditionally used.

 

Rich Malasics, 414 Blackhorse Road, Tax Parcel 25-7-16 commended the Road Crew for the work they did along the intersection of Route 100 and Blackhorse Road.  He stated that this is now much safer.  Miller stated that they moved the school bus road side stand and from now on the Township will mow at the end of the road. 

 

Miller was asked on when Hollow Road was to be paved.  He stated that the culverts will need to be repaired first.  Hollow Road is scheduled to be paved this year. 

 

Perkins made a motion to adjourn, DiLibero seconded, and the motion passed unanimously.
