Attendance: Chairman Kenneth Miller, Vice Chairperson Zoë Perkins , Barry DiLibero, Township Manager Jim Wendelgass, Allan Greenwood of Siana, Bellwoar & McAndrew, LLP Township Solicitor, and Township Secretary Tammy Swavely.

Chairman Miller called the meeting to order at 2:00 PM.

The Board has called a Special Meeting to render a decision on the Land Development Application of Birchrun Village LLC.

Solicitor Greenwood stated that this meeting was advertised and presented a proof of publication that the notice of the Special Meeting was advertised August 27, 2008 in the Daily Local News.

Miller read the following Decision:

And Now, this 29th day of August, 2008, the Board of Supervisors of West Vincent Township (“Board”) hereby DENIES the Preliminary Subdivision and Land Development Application of Applicant Birch Run Village LLC for the reasons as set forth more fully above, which are incorporated herein and made part of this Decision as if fully set forth herein.

Miller made the motion that the Board deny the Land Development Plan of Birchrun Village, LLC which includes six (6) pages with Findings of Fact, Discussion, and Decision. Perkins seconded the motion and the motion carried unanimously.

DiLibero asked if there could be a sign put up at the intersection of Birchrun Road and Pottstown Pike. These are both state roads and Penn DOT will need to be contacted.

DiLibero asked if the sign on the truck trailer advertising the apartments at Oxford Rise has been removed. Wendelgass stated that the company has been contacted to do so.

Perkins made the motion to adjourn which was seconded by DiLibero.

Meeting adjourned 2:10 PM.
