Board of Supervisors Meeting

Attendance:  Chairman Kenneth Miller, Vice Chairperson Zoë Perkins , Barry DiLibero, Township Manager Jim Wendelgass, Allan Greenwood of Siana, Bellwoar & McAndrew, LLP Township Solicitor, Zoning Officer Sandra Cantrell-Edwards and Township Secretary Tammy Swavely.

 

Chairman Miller called the meeting to order at 7:37 PM

 

Reports:

 

Township Building:  Wendelgass informed the Board that a contractor inspected the roof and siding for the leaks last week.

 

Township Manager Report:  The Township Manager Report for the week ending 3/22/08 was acknowledged as submitted. 

 

Active Subdivision List:  An Extension Request was received from John Bachich on behalf of Woodstone Homes for the Burch Subdivision.  Perkins made the motion to accept the extension request until 6/26/08.  This motion was seconded by DiLibero which carried unanimously.  An Extension Request was received from John Diemer for the Birchrun Village Land Development.  Perkins made the motion to accept the extension request until 8/31/08.  This motion was seconded by DiLibero which carried unanimously. 

 

Bills List:  The Bills List was reviewed.  Perkins made the motion to approve the Bills List dated 3/20/08 in the total amount $99,172.85.  DiLibero seconded the motion and it carried unanimously.

 

Correspondence:

A Fax from was received from Judy Rosato, Ludwig’s Corner Horse Show requesting the use of the Township Meeting room.  Perkins made the motion to permit the Ludwig’s Corner Horse Show Association on April 2, 2008 at 6:00 PM.  DiLibero seconded the motion which carried unanimously. 

 

An invitation from Ridge Fire Company to the Annual Fireman’s Banquet on April 19th at 6:00 PM was acknowledged as received. 

 

A letter dated 3/14/08 from Special Agent Gerard O’Callaghan congratulating Police Chief Michael Swininger on his completion of the 232nd FBI National Academy was acknowledged as received.

 

The Annual PSATS Convention is May 11-14, 2008.  If anyone wishes to attend please contact Township Secretary Swavely to sign up.

 

An invitation from Owen J. Roberts School District to attend a District Administrators meeting on May 22 was acknowledged as received.  All Board members and Township Manager Wendelgass will attend.

 

A request to reserve the gazebo on June 14th was received.  The Board will table this until a procedure can be developed.

 

Subdivision/Land Development:

 

Oxford Rise:  An escrow release request # 6 has been received on the Waste Water Treatment Plant.  Perkins made the motion to forward this to Castle Valley Consultants for review.  DiLibero seconded the motion which carried unanimously. 

 

New Business:

 

Nancy McLane & Jeffery Lewis, 2380 Flowing Springs Road, Tax Parcel 25-4-43 came before the Board to discuss the construction of a new driveway with respect to Zoning Ordinance 2103.G.  This states that no driveway shall be situated less than 10 feet from a side or rear property line. This setback may be reduced at the discretion of the Board of Supervisors, but in no case to less than 5 feet, with some exceptions.  This property is approximately 20 acres and an easement has been placed on it to allow one house.  To reduce the amount of tree removal, Lewis would like to place his driveway 5 feet from the edge of his property.  This also is an existing horse trail.  When the driveway is constructed, the trail will begin at this point.  The trail is recognized on the plans and goes through to the neighboring property.  DiLibero would like to make a site visit before making a decision.  Perkins added that she would like to recognize the people who came out in support of the trail on the Lewis/McLane property.  This will be tabled until next Monday morning. 

 

Harriet Stone, EAC member, informed the Township of Earth Hour.  This began in Sydney, Australia in 2007 and this year has expanded to include the world.  It was created to take a stand against global warming.  Earth Hour uses the simple action of turning off the lights for one hour to deliver a powerful message about the need for action.  Perkins made the motion to adopt Resolution 12-2008 which was seconded by DiLibero and carried unanimously:


WHEREAS, the adverse impacts of energy waste on the environment must be of concern to all West Vincent Township citizens and businesses; and
WHEREAS, we sometimes need to be reminded of the role we each need to play in energy conservation and environmental protection; and
WHEREAS, the West Vincent Township Board of Supervisors encourages energy conservation by its citizens and businesses; and
WHEREAS, the evening of March 29th from 8 until 9 has been designated around the world as Earth Hour, a time for citizens and businesses to demonstrate their commitment to the environment and energy conservation by extinguishing all but essential outdoor lighting during that period;

NOW THEREFORE, we, the Board of Supervisors of West Vincent Township on this 24th of March, 2008 do hereby designate the hour of 8:00 to 9:00 PM on the evening of March 29th , 2008 as EARTH HOUR

 

And hereby call upon the citizens and businesses of the Township to observe the occasion by extinguishing all but essential outdoor lighting during that hour. 

 

Business from the floor:

 

Harriet Stone, EAC member came before the Board of Supervisors to request that a local historian be appointed to the EAC.  It would also be her desire to have an Historical Committee if possible.  This would require an ordinance.  Stone explained that this committee would be able to review plans with historic significance and also update the current historic site list.  Perkins stated that many people in the Township do not want an HARB, Historical Architectural Review Board because they do not want to be told what they can and cannot do with their properties.  Stone will research what kinds of alternative committees can be formed and come back to the Board.  Karen Marshal, Chester County Historical Committee, would be available to discuss this with the Board to answer any questions. 

 

French and Pickering Creeks Conservation Trust’s Land Preservation Committee would like the Township’s representatives to the Northern Federation to support work that is being proposed to construct a segment of trail from Route 100 west to Elverson.  They plan to start near St. Peter’s along the Boar’s Back Railroad bed.  Pam Brown, FPCCT, stated that this is to begin construction and get the Agreements between the county and three (3) different entities.  This is for actual building of a trail, not just a plan.  Perkins made the motion that the Township representatives to the Northern Federation request that the Northern Federation support the request made by French and Pickering Creeks Conservation Trust’s Land Preservation Committee to construct a trail from Route 100 west to Elverson.  DiLibero seconded the motion which carried unanimously. 

 

Miller announced that there was going to be an Executive Session to discuss possible litigation.
