Board of Supervisors Meeting

Attendance:  Chairman Kenneth Miller, Vice Chairperson Zoë Perkins , Barry DiLibero, Township Manager Jim Wendelgass, Allan Greenwood of Siana, Bellwoar & McAndrew, LLP Township Solicitor, and Township Secretary Tammy Swavely. 

Chairman Miller called the meeting to order at 7:36 PM

The minutes of May 12, 2008 were unanimously approved as amended on a motion by Perkins and a second by DiLibero.

Reports:

Township Building:  A quote has been received to update the Emergency Management telephone system by GALCO, the company who maintains the Township’s phones.  Perkins made the motion that the Township purchase the phone system from GALCO in the total amount of $1,380.00 to provide updated telecommunications for the Emergency Management Office.  DiLibero seconded the motion which carried unanimously. 

Township Manager Report:  The Township Manager Report for the week ending 5/24/08 was acknowledged as submitted.  Wendelgass informed the Board that he was just contacted by Signal Services, the company who is contracted to maintain the traffic signal in West Vincent Township.  They inform him that the box for the controls has been damaged and it needs to be replaced since it is no longer water proof.  Perkins made the motion that the Board approve the repair to the Ludwig’s Corner traffic signal with the repair costs estimated in the total amount of $600.00.  DiLibero seconded the motion which carried unanimously. 

Active Subdivision List:  There are currently no pending deadlines. 

Bills List:  The Bills List was reviewed.  Perkins made the motion to approve the Bills List dated 5/23/08 in the total amount $225,428.20.  DiLibero seconded the motion and it carried unanimously.

Correspondence:

An informational brochure has been received from the DEP regarding grants that are available to help local governments reduce greenhouse gas emissions.  This will be forwarded to the EAC.

Subdivision/Land Development:

Eagle Farms: An Escrow Release Request was received from Toll Bros. for the Eagle Farms Subdivision.  Perkins made the motion that this request for the Ewing Tract for Sanitary Improvements on Bond #8878003 from Toll Bros. be forwarded to Carroll Engineering for review and recommendation.  This was seconded by DiLibero and carried unanimously.  An escrow release request approval has been received for the Ewing Tract Eagle Farms Road for Phase 1-2 A for site improvements.  Perkins made the motion that the escrow in the total amount of $1,246,148.48 be released to Toll Bros. DiLibero seconded the motion which carried unanimously.  An escrow release request approval has been received for the Eagle Farms Road improvements for Phase 1 and 2A.  Perkins made the motion that the escrow in the total amount of $60,797.74 is released to Toll Bros. for improvements in the Eagle Farms Road Phase 1-2 A.  DiLibero seconded the motion which carried unanimously.

Old Business:

West Vincent Township’s Community Day was held on May 10, 2008.  The following were the donors to make the event special:  Toll Brothers, Oxford Properties, The Cutler Group, Carroll Engineering, DNB First, The Hankin Group, NOVA Savings Bank, Orleans Homebuilders, Sunrise Senior Living Management, Siana, Bellwoar & McAndrew, LLP, Haines and Kibblehouse, Dewey & LeBoeuff, LLP, James Cochrane Realty, Crossroads Church, Birchrun Village, WK Frame, PECO Energy, Woodstone Homes, Cedar Hollow Recycling, Ambrose Peterman III, Family Medicine, Kenneth Carroll Real Estate, MySherpa, Ludwig’s Corner Riding and Driving Club.  The following donated goods and services:  Birchrunville Store Café, Chick-fil-a, Crystal Springs, Elaine’s Flowers, Hairwaves, Kimberton Coffee, Laurel Printing, Ludwig’s Corner Hardware, Ludwig’s Inn and Oyster Bar, Ludwig’s Village Market, Sandy Malamed, Birchrunville Artist, Sommerset Nursery, The Bakery at Chester Springs, Top of the Hill Beverage, Village Optical, and Walmart. 

New Business:

West Vincent Township has determined that a speed limit is necessary on certain roads in West Vincent.  Perkins read the proposed Ordinance 141-2008:  An Ordinance of West Vincent Township, Chester County, designating a maximum speed limit for South Chester Springs Road, and providing for the posting of said speed limit at required intervals.  Perkins made the motion that the Board of Supervisors adopt Ordinance 141-2008 as read this evening in its entirety consisting of six (6) sections on three (3) pages.  This motion was seconded by DiLibero which carried unanimously.  DiLibero read the proposed Ordinance 142-2008: An Ordinance of West Vincent Township, Chester County, designating a maximum speed for certain local township roads, within the Weatherstone development and providing of said speed limit at required intervals.  DiLibero made the motion that the Board of Supervisors adopt Ordinance 141-2008 as read this evening in its entirety consisting of six (6) sections on three (3) pages.  This motion was seconded by Perkins which carried unanimously.

Business from the floor:

Maureen Tedesco, 542 Black Horse Road, Tax Parcel 25-7-18.3 came before the Board of Supervisors to discuss the problem she is having with drainage on her property the last few years.  She stated that the problem went away last fall, but has resurfaced again.  She is selling her home.  A company has told her that her septic will not pass due to all the water in her yard.  She would like the Township to help her with a permanent fix.  Miller stated that he cannot allow the road crew on her property to do any work that is out of the right of way without the entire Board’s permission.  He stated that there are springs along Black Horse Road and that they dry up in the fall, that is why it seems to be temporarily fixed.  The water problem is not caused by stormwater, but spring water.  Miller stated that since the property is downgradient from the road, the water drains to the back of the Tedesco property.  Perkins stated that the Township Engineer should to make a site visit and see what can be done.

Cary Leptuck, 1425 Birchrun Road, Tax Parcel 25-3-109.2B came before the Board of Supervisors to discuss events that followed the petition that a group of citizens presented on January 28, 2008 regarding the residency of Barry DiLibero.  Leptuck stated that a Quo Warranto was filed on May 7, 2008 by the District Attorney.  He and other concerned citizens are worried about the time frame in which this will take, which could be up to one year.  He would like to know if the Board could speed up the process by contacting the District Attorney.  Leptuck is concerned that Township business that is being conducted at this time could be in jeopardy.  Miller agreed with Leptuck and stated that he is sure DiLibero would also like to get this moving along and come to a conclusion.  DiLibero stated “he didn’t see a reason why the DA would drag his feet on it.”

Miller announced that there would be an Executive Session immediately following the regular meeting to discuss on going litigation.
